L&M Obtains Critical Motion To Quash
Protective Order Granted By Superior Court
Sep 18, 2005 -- On Thursday, September 15, the Middlesex Superior Court granted Howard's client, Language Testing International, a critical Motion To Quash and Protective Order that protected the client's interest in avoiding important trade secret and proprietary testing information from being disclosed and released to the City of Lowell sought as evidence in a teacher discharge case. The client had been served with a subpoena to produce information about its proprietary language testing process and the subpoena had been enforced by a prior order of the Superior Court. In granting the Motion To Quash, the Court, without issuing a detailed opinion, apparently agreed that LTI had a compelling interest in protecting its intellectual property interests and adopted the company's proposal for a protective order.
