Suffolk Superior Court Issues Injunction for John P. Horan
Jul 26, 2005 -- Last month, the Suffolk Superior Court issued an injunction on behalf of John P. Horan, President of OPEIU Local 600 in Boston, in his bid to run for office as a Board member of the MBTA Credit Union. The Credit Union had declared Horan ineligible to run for office because the Board claimed that they were going to be reviewing charges of misconduct against Horan after the election and that the Board had the authority to determine elegibility to run for office. Horan's attorney, Howard Lenow, brought the action under the simple theory that the Board's by-laws did not grant such authority to the Board and that the Board was obligated to place Horan's name on the ballot. The Court granted the injunction and the Board's ex-parte appeal to the Appeals Court was denied. Horan went on to win a seat to the Board.
