Superior Court Affirms Civil Service Bypass Victory for Natick Fire Chief
Gene Sabourin Appointed Chief After Five Years of Litigation
May 28, 2006 -- The Superior Court affirms Gene Sabourin's five year quest to become Fire Chief for the Town of Natick. Ending a five year struggle, the Superior Court affirms the decision of the Civil Service Commission to grant Sabourin his historic bypass appeal. Finding that the Board of Selectman used a flawed interview and selection process, the Court directs that the Town of Natick must revert to the list that virtually required the appointment of the more qualified candidate to the Chief's position. Gene Sabourin is finally sworn into the position for which he should have been appointed five years before. In the process, the initial hearing officer had left his position with the Civil Service Commission requiring a second hearing before a new hearing officer. After winning a the Civil Service Commission, the Town refused to comply with the Decision forcing Attorney Sheilah McCarthy to appeal the decision to Superior Court. By the time of the Court's decision, the wrongly appointed Chief announced his retirement and Sabourin is finally sworn in.
